Digital Wallet Privacy Policy

CiNKO (“CiNKO”, “we”, “us” or “our”) operates under Payments and Electronic Money licenses from regulators in Latin America and the Caribbean. This privacy statement covers data privacy of account users. CiNKO policies and procedures are subject to change.

In the course of serving its customers, CiNKO acquires, stores and transmits customer communications and information that customers may regard as private or sensitive. Some of this information – such as the customer’s name, address, telephone number, transaction and credit card data – is provided to CiNKO by its customers in order to establish service. In addition, CiNKO may store customers’ electronic mail and other communications as a necessary incident to the transmission and delivery of those communications.

CiNKO will protect the confidentiality of its customers’ information, account information and personal communications to the fullest extent possible and consistent with the laws of the Bahamas. To protect the loss, misuse, and alteration of information that is collected from customers, CiNKO has appropriate physical, electronic, and managerial procedures in place.

How is Customer Information Used?

CiNKO will never share customer information with partners, suppliers, affiliate, local or foreign, law enforcement or regulatory authorities unless in a manner as described in this privacy statement.

In circumstances where customers are proven to be involved in fraud and/or money laundering, CiNKO may be forced to comply with certain local laws and provide selected information to local authorities, the Attorney General or Supreme Court.

CiNKO may use customer information internally to provide its customers with system information or information about new or upgraded products.

Customers may access and modify their personal information by via the CiNKO Application. CiNKO does not share, sell, rent, or trade personal information with third parties for their promotional purpose. CiNKO will not otherwise disclose its customers’ personal and account information unless CiNKO has reason to believe that disclosing such information is necessary to identify, make contact with, or bring legal action against someone who may be causing harm or interfering with the rights or property of CiNKO, CiNKO customers, or others, or where CiNKO has a good faith belief that the law requires such disclosure.

CiNKO also will not, except for reasons stated below, disclose to third parties the contents of any electronic mail or other electronic communications that CiNKO stores or transmits for its customers. The circumstances under which CiNKO will disclose such electronic customer communications are when:

  • it is necessary in order to provide service to the customer;
  • it is necessary to protect the legitimate interests of CiNKO and its customers;
  • it is required to cooperate with interception orders, warrants, or other legal process that Island determines in its sole discretion to be valid and enforceable; and
  • it is necessary to provide to a law enforcement agency when the contents are inadvertently obtained by CiNKO and appear to pertain to the commission of a crime.

Changes in This Privacy Statement

If we decide to change our privacy policy, we will post those changes to this privacy statement, the home page, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.

We reserve the right to modify this privacy statement at any time, so please review it frequently. If we make material changes to this policy, we will notify you here, by email, or by means of a notice on our home page.

In the event there is a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personally identifiable information will likely be among the assets transferred. You will be notified via email or prominent notice on our Web site for 30 days of any such change in ownership or control of your personal information.

CiNKO disclaims any intention to censor, edit or engage in ongoing review or surveillance of communications stored on or transmitted through its facilities by customers or others. CiNKO will, however, review, delete or block access to communications that may harm, CiNKO, its customers or third parties. The grounds on which CiNKO may take such action include, but are not limited to, actual or potential violations of CiNKO.
